License Terms (EULA)
End user license agreement for DiskDonut and DiskDonut Pro – draft.
Deutsche Fassung · In case of doubt, the German version prevails.
1. Scope
These terms govern the use of the software “DiskDonut” (the “Software”) provided by Chor Thongthip, Ronin Studios, Kantstr. 32, 85356 Freising, Germany (the “Provider”). If you obtain the Software from the Mac App Store, Apple’s Licensed Application End User License Agreement applies first; these terms apply in addition where they do not conflict with it.
2. Free version
The Provider grants you a simple, non-transferable, perpetual right to use the free version of the Software for private and professional purposes.
3. DiskDonut Pro
With the one-time purchase of DiskDonut Pro (in-app purchase on the Mac App Store or a licence key for the direct download) you receive a simple, non-transferable, perpetual right to use the Pro features on up to five (5) Macs that you own or personally control. This is not a subscription. Licence keys must not be shared with third parties or published. Team and education licences are agreed separately.
[CHECK: define the scope of future updates, e.g. “all updates of version 1.x”.]
4. Restrictions
To the extent permitted by law, you may not modify, decompile, reverse engineer or rent out the Software, or circumvent its licensing mechanisms. Mandatory statutory rights remain unaffected.
5. Responsibility when removing files
The Software shows safety levels and reasons, moves files to the Trash by default and never removes files automatically. You decide whether to remove or permanently delete files. Please make a current backup (e.g. with Time Machine) before cleaning up.
6. Warranty and liability
Statutory warranty rights apply. The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage; otherwise liability for slight negligence is excluded. For loss of data, the Provider is only liable to the extent that would have occurred had proper backups been made. [CHECK]
7. Privacy
The Software works locally and does not collect personal data. See the privacy policy for details.
8. Final provisions
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
